Rawls’s difference principle and the position dubbed ‘luck egalitarianism’ are often viewed as competing theories of distributive justice. However, recent work has emphasised that Rawlsians and luck egalitarians are working with different understandings of the concept of justice, and thus not only propose different theories, but different theories of different things. Once they are no longer seen in direct competition, there are some questions to be asked about whether these two theories can be consistently endorsed alongside one another. In this (...) essay, I (begin to) investigate whether Rawls’s theory (or elements of it) and (some form of) luck egalitarianism can be consistently endorsed. -/- I begin by outlining the main aspects of Rawls’s theory and luck egalitarianism, showing them to be different kinds of theory and therefore not in direct competition. I then propose an understanding of how these ideas came to be seen to be in direct competition. Finally, I outline five different ways in which one might consistently be (some kind of) a luck egalitarian and (some kind of) a Rawlsian, and try to say something about what is to be said for and against each of these ways of combining the theories. The Polymath Project is an online collaborative enterprise that was initiated in 2009, when Timothy Gowers asked whether and how groups could work together to solve mathematical problems that “do not naturally split up into a vast number of subtasks.” Gowers proposed to answer this question himself by actually trying to set up such a collaboration, based on interactions taking place in the comment-threads of a series of posts on a WordPress blog. Hence, the first project officially started in early (...) 2009, to be proclaimed successful only 6 weeks later (Gowers and Nielsen 2009). From its inception until April 2018, 15 more Polymath problems (and a handful of smaller or related ones) have been launched. These projects have attracted attention from different scholarly communities, including the philosophy of mathematical practices, from the perspective of which the Polymath Project can be seen as a vast repository of mathematics in action. This chapter continues previous work by its authors on the topic in question and topics related. More specifically, for the purposes of this volume, it is our aim to both summarize and expand upon these earlier contributions. The starting point is the above observation that in the past decade, the issue of “massively collaborative mathematics” (to be qualified below) has drawn quite some attention. However, does it also warrant intensive philosophical attention in particular? For, as exciting as these developments might be from mathematical and other points of view, the enhanced possibilities that have come with it do not per se give rise to any philosophical import. In Van Bendegem (2011), one of us has indeed tentatively argued for the philosophical relevance of these new dynamics of proof construction flowing from the wide availability and efficiency of Internet technology. Thomas & Karmiloff- Smith raise the excellent and, in retrospect, obvious point that in a dynamic learning environment where feedback is possible, we should expect networks to adapt to damage by altering details of their behavior. We should therefore not expect that developmental disorders should result in “normal” modules. The implications of this point go much further, since interprocess dependency in the brain does not rely only on learned neural connections. This argues strongly against behavioral and process-related definitions, as opposed (...) to structural and architecture-related definitions, of mental modularity. (shrink)

The distinction between “passive” and “active” euthanasia, though problematic and highly criticized, retains a certain intuitive appeal. When a patient is allowed to die, nature appears simply to be taking its course. Yet when a patient is killed by, say, a lethal injection, humans appear to be causing his or her death. Guilt seems to follow naturally from the latter act while not from the former. Yet this view only holds up if age‐old and vague ideasabout “nature” and “artifice” go (...) unscrutinized. Once examined more closely the functional relevance of particular machines to particular bodies becomes evident. And the innocence and guilt less clear. (shrink)

The well-known classification of legal procedure into “four feet” presents certain conceptual problems for the Indian legal tradition that various Smṛtikāras and commentators have attempted to resolve in different and sometimes contradictory ways. These difficulties arise because the four feet originally referred in Indian legal theory to four distinct, hierarchical legal domains rather than procedural means for reaching a verdict. The earliest attested discussion of the four feet, found in Kauṭilya’s Arthaśāstra, indicates that early legal theorists understood the greater legal (...) order as being comprised of four hierarchical domains and that these domains were ordered by the state as expressed in the original formulation of the four feet. Among the four legal domains, that of vyavahāra was developed by the state itself as a realm of public, transactional law meant to address disputes that could not be resolved in other legal forums. From this we can conclude that the origin of Indian jurisprudence lies with state efforts to formalize and enforce the laws of public transactions. The reinterpretation of the four feet by later jurists was motivated perhaps by resistance to one of the fundamental relationships expressed in the four feet, namely that royal authority possessed the greatest legal authority, independent of Brāhmaṇical law. This paper argues that it is permissible for computer scientists and engineers—working with advanced militaries that are making good faith efforts to follow the laws of war—to engage in the research and development of lethal autonomous weapons systems. Research and development into a new weapons system is permissible if and only if the new weapons system can plausibly generate a superior risk profile for all morally relevant classes and it is not intrinsically wrong. The paper then suggests that these conditions (...) are satisfied by at least some potential LAWS development programs. More specifically, since LAWS will lead to greater force protection, warfighters are free to become more risk-acceptant in protecting civilian lives and property. Further, various malicious motivations that lead to war crimes will not apply to LAWS or will apply to no greater extent than with human warfighters. Finally, intrinsic objections—such as the claims that LAWS violate human dignity or that it creates ‘responsibility gaps’—are rejected on the basis that they rely upon implausibly idealized and atomized understandings of human decision-making in combat. The various academic works about the analysis of the actual functionning of alternation in professionnal training reveal a great descrepancy with the prescriptive model, qualified institutionnal or organisationnal model. In order to take some distance from this technical coordinative model of alternation in training, the hypothesis is made that the alternant is the one creating bonds.The results of an active resarch, based on the experimentation of a pro-training arrangement made to support this bonding work, are presented and put in perspective (...) with the initial hypothesis. This bonding work is considered a reliance activity of the alternants. Also, the pro-training arrangement built from the richness of the class-group, born from the commitment of the alternants, creates a typical dynamic which we chose to call actor-network. (shrink)

By means of this phantasy he protects himself against the effect of his experience. Thus Shakespeare is right in his conjunction of poetry with "fine frenzy." According to the editor, Ernst Kris, who provides an excellent preface (...) to the whole volume and very knowledgeable footnotes, Freud developed the above ideas in Interpretation of Dreams (1900), Der Wahn und die Triiume in W. Jensens "Gradiva" (1907), and Der Dichter und dos Phantasieren (1908). Another "note" in the same enclosure gives a "Definition of the Holy": "Holy" is that which consists in the fact that men have sacrificed a part of their freedom of sexual perversion for the good of a larger community. The abhorrence of incest (wicked) is based on the fact that as a result of sexual promiscuity (also in childhnod) the members of the fainily continuously hohl together and become unable to join strangers. It is therefore antisocial. Culture consists in this permanent renunciation. As against this the "superman." Kris comments thus: "This seems to be the earliest formulation of Freud's view that the process of civilization is inimical to drives (Triebfeindlichkeit). It was later on expressed in The "cultural" sexual murder and the modern nervousness (1908), in Totem and Taboo (1912-13), in Das Unbehagen in der Kultur (1929) and in Why War? (1932). This shows clearly, however, that Freud regards the philosophy of Nietzsche as a revulsion against the process of civilization as such, or as one of the symptoms of this revulsion. In a letter of January 1, 1898 (p. 209), Freud gives a definition of happiness: "Happiness is the subsequent fulfillment of a prehistoric wish. Therefore riches bring one very little happiness. Money is no child-wish." "Prehistoric" means here the stage of early unremembered childhood. Freud is a rigorous determinist, and he states in a supplement to a letter of August 27, 1899: "There is nothing arbitrary or undetermined in the psychical." This determinacy concerns even such trivial facts as why Freud imagined the figure of 2467. The self-critical acumen of Freud is remarkable. In a letter of October 31, 1895, shortly after the writing of the Draft of a Psychology, he writes to Fliess (about the latter's ideas): "First impression: Surprise that there is one man who is still more of a visionary than myself and that this happens to be my friend Wilhelm" (p. 116). Freud employs here the expression "Phantast" (for visionary) which means that his own (Freud's) ideas and those of Fliess are "phantastic." This is of course primarily a criticism of Fliess. Professor Kraft-Ebbing (author of Psychopathia sexualis and head of the clinic of nervous diseases in Vienna), who was friendly to Freud and helped him to gain the title of professor of the university but remained sceptical--just as did Breuer--called Freud's theory "a scientific tale" (ein wissenschaftliches Miirchen). This paper argues that the augmented reality gaming application for smart devices, _Pokémon GO_ shows the fate of the legal subject as a neoliberal monster subjugated to the limitations imposed by hypercapitalism. The game, derived from Nintendo’s iconic Pokémon franchise, reveals the legal subject as a frenzied, diminished and impulsive being, allowed to see, move, catch and accumulate but unable to participate in more meaningful self-narration. It is not that the game is lawless, notwithstanding, anxieties in the semiosphere about users (...) trespassing or engaging in criminal behaviour. Rather the game is over structured and highly limited, both within its game-play which is repetitive and impulsive, and in its absence of narrative. Unlike the classic Nintendo Pokémon games which are within the role-playing game genre, _Pokémon GO_ abstracts the seeing, moving, catching and accumulating features of the classic games without the overarching narrative, questing and competition. In this _Pokémon GO_ manifests the transformation of the liberal legal subject of capitalism to the neoliberal subject of a digital orientated hypercapitalism where seeing, moving, catching and accumulating is immediate and impulsive, obliterating the ‘prudent’ subject participating in their own self-narration. This paper provides a response to Hanna Pickard and Stephen Pearce’s paper ‘Balancing costs and benefits: a clinical perspective does not support a harm minimisation approach for self-injury outside of community settings.’ This paper responded to my article ‘Should healthcare professionals sometimes allow harm? The case of self-injury.’ There is much in the paper that I would agree with, but I feel it is important to respond to a number of the criticisms of my paper in order to clarify my (...) position and to facilitate ongoing debate in relation to this important issue. L’article commence par dresser un résumé de la controverse sur la traduction d’ Aufhebung qui, depuis la fin des années 1990, a opposé l’auteur à Lucien Sève, qui prit soin de récuser l’« idée fausse, non marxienne d’abolition » pour lui substituer celle de « dépassement ». Après avoir analysé les rétractations successives de Sève, l’article élargit les données du problème traductologique en examinant les usages chez Marx et Engels d’un autre terme signifiant sans conteste « abolition » ou « (...) suppression », Abschaffung, et conclut que le concept d’abolition est bel et bien un concept clef du marxisme, comme du mouvement social et révolutionnaire porté par son époque. Electoral support for right-wing populist parties is typically explained either by economic deprivation or cultural grievances. Attempting to bring economic and cultural explanations together, recent approaches have suggested to conceptualize right-wing populist support as a problem of social integration. Applying this perspective to the German case, this article investigates whether weak subjective social integration-or subjective social marginalization, respectively-is associated with the intention to vote for the AfD. Furthermore, it asks whether the strength of this association varies across income groups. Based (...) on original survey data from 2017, the results show that indicators of weak subjective social integration-feeling socially excluded, being anxious about one’s status, and distrusting others-increase the likelihood of voting for the AfD. Moreover, weak subjective social integration increases right-wing party support particularly among the middle-class. Thus, next to fears of downward mobility, feelings of subjective social marginalization emerge as a pathway to right-wing populism for the middle-class. (shrink)

I argue that some perceptual experiences are vague. To do so, I identify a characteristic feature of vagueness and show that some perceptual experiences have this feature. These include blurry experiences, experiences of color under low lighting, and experiences of number, as in the case of the speckled hen. The conclusion that these experiences are vague has two noteworthy consequences. First, it presses us to see whether and how existing theories of vagueness can be extended to perceptual experience. An American conservative movement developed rapidly after World War II. It brought together intellectuals and politicians opposed to the New Deal in domestic policy and Soviet communism in foreign policy. The movement's first presidential candidate, Barry Goldwater, lost the election of 1964 but its second, Ronald Reagan, won the election of 1980. It has remained an influential force in American life up to the present, despite strong internal contradictions, which include disagreements about centralized power, about religion, about tradition, about elites, (...) and about the free market. To some of the movement's early luminaries, such as Russell Kirk, free-market capitalism was the antithesis of conservatism since it required perpetual innovation and the sweeping away of traditional forms. To others, such as Ayn Rand, capitalism was the heart and soul of conservatism because it alone preserved the dignity and freedom of the individual. (shrink)

Informational conceptions of logic are barely novel. We find them in the work of John Corcoran, in several papers on substructural and constructive logics by Heinrich Wansing, and in the interpretation of the Routley-Meyer semantics for relevant logics in terms of Barwises and Perrys theory of situations. Allo & Mares [2] present an informational account of logical consequence that is based on the content-nonexpantion platitude, but that also relies on a double inversion of the standard direction of explanation (in- formation (...) doesnt depend on a prior notion of meaning, but is used to naturalize meaning, and informational content is not defined relative to a pre-existing logical space, but that space is constructed relative to the level of abstraction at which information is assessed). In this paper I focus directly on one of the main ideas introduced in that paper, namely the contrast between logical discrimination and deductive strength, and use this contrast to (1) illustrate a number of open problems for an informational conception of logical consequence, (2) review its connection with the dynamic turn in logic, and (3) situate it relative to the research agenda of the philosophy of information. Many philosophers assume that philosophical theories about the psychological nature of moral judgment can be confirmed or disconfirmed by the kind of evidence gathered by natural and social scientists (especially experimental psychologists and neuroscientists). I argue that this assumption is mistaken. For the most part, empirical evidence can do no work in these philosophical debates, as the metaphorical heavy-lifting is done by the pre-experimental assumptions that make it possible to apply empirical data to these philosophical debates. For the purpose of (...) this paper, I emphasize two putatively empirically-supported theories about the psychological nature of moral judgment. The first is the Sentimental Rules Account, which is defended by Shaun Nichols. The second is defended by Jesse Prinz, and is a form of sentimentalist moral relativism. I show that both of the arguments in favour of these theories rely on assumptions which would be rejected by their philosophical opponents. Further, these assumptions carry substantive moral commitments and thus cannot be confirmed by further empirical investigation. Because of this shared methodological assumption, I argue that a certain form of empirical moral psychology rests on a mistake. (shrink)

We present an argument in support of the legal prohibition of infant male circumcision (IMC) in developed Western countries. We submit that all IMC, irrespective of whether the motivation behind it be secular or religious, violates children’s rights to self-determination (autonomy) and bodily integrity and is therefore morally illegitimate. And while IMC’s being morally wrong does not entail that it ought to be criminalised, we contend that it should be legally proscribed so as to protect children against harm and to (...) uphold their rights. We consider and reject an argument that an exemption from the legal ban should be granted to religious parents who perceive themselves to be under a moral obligation to subject their male infants to IMC. We argue that since IMC sets back children’s basic interests and violates their rights, there is no room, and no case, for the conferring of a religious exemption. (shrink)

In this paper we devise some technical tools for dealing with problems connected with the philosophical view usually called mathematical instrumentalism. These tools are interesting in their own right, independently of their philosophical consequences. For example, we show that even though the fragment of Peano's Arithmetic known as IΣ₁ is a conservative extension of the equational theory of Primitive Recursive Arithmetic (PRA). IΣ₁ has a super-exponential speed-up over PRA. On the other hand, theories studied in the Program of Reverse Mathematics (...) that formalize powerful mathematical principles have only polynomial speed-up over IΣ₁. (shrink)

Care has become an overdetermined word in the medical humanities and beyond, a focus not only of debate around the nature and purpose of the field, but also of the wider issue of the status of medicine in relation to society and the individual. As a symptom of this problematic, this article proposes care as an ‘untranslatable’, in the sense defined by Barbara Cassin. This is pursued via an engagement with the history of the ethics of care and with its (...) translation into francophone contexts as une éthique du care, in tension with the philosophie du soin elaborated in the work of Frédéric Worms, and then with the several translations into French and English of Sorge and its derivations Besorgen and Fürsorge in Martin Heidegger's Sein und Zeit (Being and Time). A genealogy of care is thus established, and what emerges as the principal motif of its untranslatability is the relation between a primary form of relationality and the socio-technical dimension in which we may recognise healthcare. This introduction provides background information on the emerging field of nanotechnology and its ethical dimensions. After defining nanotechnology and briefly discussing its status as a discipline, about which there exists a meta-controversy, this introduction turns to a discussion of the status of nanoethics and lays out particular issues of concern in the field, both current and emerging.

I defend the position argued previously by Germain Grisez and me that total brain death is a valid criterion of death on the grounds that a human being is essentially a rational animal, and a brain-dead body lacks the radical capacity for rational actions. I reply to Josef Seifert’s objection that our positions rest on a reductionist view of the human person, and to other objections concerning the inter-relation between the human soul, its powers, and functions of the brain.
